Madrid, 16 February 2025 – It has taken more than 2 years and 8 months to resolve the case of Laura Barquero, which was being processed before the Court of Arbitration for Sport (CAS). Following an agreement between the parties involved, the World Anti-Doping Agency (WADA), the International Skating Union (ISU) and the skater from Madrid, a sanction of 6 years of disqualification has been established, running from 22 February 2022 to 21 February 2028. The agreement was signed on 21 October 2024 .

This is a somewhat disproportionate punishment. Although it is acknowledged that the Madrid native had no intention of deceiving, the sentence is based on two positive tests for clostebol due to transdermal contamination with Trofodermin, a healing cream that is not suitable for sports performance and which she accidentally came into contact with, as confirmed by two scientific tests on her hair.

As there were two positive tests, which caused a delay, the sanction could have been even longer. In these cases, the full sanction for the first test (4 years) could be added to the double for the second (8 years). Thanks to an agreement between the parties that includes an express acknowledgement of not having intentionally deceived, the sanction was set at 6 years and the case was avoided being prolonged even further with two proceedings before the CAS that, in the best of scenarios, would have reduced the sanction to 5. If WADA had considered the positive tests to be intentional, it could have been raised to 12 years.

After the decision was made public, Laura Barquero spoke for the first time with the media about her case and did so on HIELO ESPAÑOL .

In order to understand what happened, the Madrid native contacted a clostebol expert, a renowned forensic toxicologist and expert in drugs and doping, who recommended that she undergo a hair test. Unlike urine and blood tests that only detect recent ingestion, hair testing can provide an exhaustive chronological trace. This is because hair is like a large rubbish bin in which the substances we consume are deposited for a long time.

The hair test took place ten days after the first positive result , on February 28, 2022, and was negative . Several products that Laura Barquero had brought to Beijing and that had been stored in the same drawer as the Trofodermin were also studied. The result is that several items showed the presence of clostebol acetate . The highest dose was found in an arnica gel.

According to the toxicologist, the only possible explanation for the positive result would be cross-contamination with objects contaminated by the cream , since it has been scientifically proven that clostebol is absorbed quickly and easily through transdermal contact. In his conclusions, he argued that exposure to such low amounts of clostebol could not have resulted in any improvement in athletic performance.

Thus, although the International Skating Union called Barquero “negligent”, it considered the non-intentional presence of the component to be proven and, therefore, imposed the minimum possible sanction: 1 year. As stated in the consent award signed on September 6, 2022: the ISU imposed a suspension period from February 22, 2022 to February 21, 2023.

The decision was appealed by the World Anti-Doping Agency, which considered that there were aspects of the process that had not been sufficiently investigated: who had provided the cream, where and how it had been acquired, etc.

Although the sentence was appealed, as there was no new one, Laura Barquero and her partner Marco Zandron returned to prepare for the 2023 world championships that would take place in Saitama (Japan). Following the regulations, they returned to training two months before completing the year of suspension, but a few days after skating again, she tested positive for clotella again.

“A few days after I started training, I underwent a new anti-doping test and again tested positive for clostridium, with new hair studies confirming that the most likely cause was transdermal contamination and not the use of the substance,” he explains.

“ I can’t give much more information about the second positive because I don’t have it . I had taken all the precautions, I changed my routine to avoid any risk of contamination.” I practically lived in a glass case, I was careful with everything. It couldn’t be possible. Again I thought it had to be a mistake. I quickly contacted the scientist and he told me to go immediately to the toxicology center to have the appropriate tests done.

Hard to say. I mean, if I'd had an adverse finding from a scar cream bottle that leaked in my vanity drawer & it caused an adverse finding, I'd probably have thrown out ALL the products that were in that drawer AND moved to a new place in order to prevent another contamination.

I wouldn't move. I would throw out all those products, scrub that drawer like crazy, and add a liner to it. If she did that and is still coming into contact with this substance, I wonder if it's in something else in the house. I also wonder if someone is sabotaging her. This assumes she isn't using this stuff somehow but if it's not in her hair, I don't see how that could be.

This just seems like a snotty comment from WADA.

"If Ms. Barquero did not agree with the proposed sanction, she was not obliged to sign the case resolution agreement and was free to take the case forward for hearing at CAS," WADA said.

Surely, there is no prohibition on her complaining about what happened to her. They can zip it. And Sinner's sanction was BS given what they've done to others.
 
Their "explanation" is that they believed Sinner, and they didn't believe Barquero, with the added slam implication is that if she had truly not been negligent that she would have appealed to CAS.

She went to a lot of trouble and expense to prove that her eyelash gel caused the finding as it had an ingredient that turned into a banned substance. Also she was able to get WADA to change the threshold for the substance being tested for because it was so low that it was catching people who used beauty products and weren't doping. For which, I salute her!
