Interesting interview the documentary filmmakers that covers a lot of ground:
Something also that we’ve been thinking about a lot that applies to Britney, but also to all conservatorships, is this idea of consent. They keep saying it’s a voluntary conservatorship, and we’re still trying to figure out what exactly that means. What a lot of people in their coverage of this and in the letter of the law are not taking into account is the idea of coercion and power dynamics. She’s saying, “I felt forced into this facility,” and they might come back and say, “Well, she signed herself in. How could she be forced?” But they’re not taking into account what we’ve been talking about a lot post-#MeToo, which is power dynamics and how not objecting to something doesn’t necessarily mean you’re consenting to it.

She even said in court that she felt like she got punished if she stood up for herself. She talked about having visits with her kids or boyfriend taken away. And so, if you’re a person who they’re signing a paper saying you consent to something, but being given consequences if you don’t — very severe consequences, it sounds like, from what she said — that’s not being taken into account. So letter of the law, they can’t force her into a facility, and then they’re saying, letter of the law, “We didn’t do it. She signed a consent form.” That seems like it could happen in all conservatorships.

The latter part of the quote raises a few questions for me regarding vulnerability to easy manipulation, which was a cited reason for conservatorship. I also think she was set up to be put in that position because nobody had her best interest at heart to truly let her know what her rights were so she could be empowered to exercise them.

Has she gotten a new attorney yet? Have they filed a petition to end the conservatorship yet?

The new attorney demanded that Jamie Spears step down and so far he has declined. According to reports I read, daddy and brother Spears have made several comments over the years referring to it as the "family business" & I don't think they mean taking good care of Britney Spears.

It's troubling that even if a conservatorship is necessary why her father insists that he be in control of it. All of the family admits that he wasn't around, let alone supportive, while Britney was young, or even at the beginning of her career. The family has acknowledged that he was abusive and had issues with drinking and drugs.

I hope that this new lawyer does a full investigation on everything. Jamie Spears is an opportunist capitalizing off of his daughter's situation. It needs to be stopped.

A positive step in the right direction. Whether or not she needs a conservatorship is one question, but it's clear her father and a bunch of other people with monied interests or at least dependence in Spears should not be in charge of it. Sad it took so long to do it, and the fact that she needed a new lawyer to get any traction done on this. It seems her older lawyer wasn't advocating for Britney the way he should have been and I question how dependent he was on the fee he was collecting by being her court-appointed lawyer. The ABA should at least look into it even if they decide nothing untoward happened.

If she passes an evaluation she would be free of the conservatorship, doesn't she?

Does anybody know what kind of questions they ask or what they test? Drug test, maybe? But if she takes prescribed meds, this shouldn't be a problem.

And why is she so afraid of this evaluation? She talks clearly, argues logically, she is intelligent. What could be the problem?

@Husky I think the questions that are asked in an evaluation depend on the reasons for the conservatorship and what it covers. The questions would be different in every case depending on the situation. But generally they would be looking to determine whether the person is capable of managing whatever the conservatorship is currently managing.

I would imagine she's afraid of the evaluation because the conservatorship has been in place for so long. So she might think there has to be some pretty compelling evidence to end it, and that she will be subjected to some pretty intense questioning.

Maybe they are monitoring and judging her by her body language. I know that some psychologists base their judgement on gestures and how you talk. This isn't transparent for the patient.

No. A psych eval/competency eval is much more than that.
I can understand her fear. She fears being re-traumatized.
FWIW the conservatorship was abusive and didn't give her the opportunity to trust herself and heal.
Forcing her to go to therapy 3 days a week is abusive as well.

There are therapies that require 3 sessions per week. During the last lockdown I considered making a therapy for the first time in my life and I was introduced to the different types. The psychoanalysis, which is an in-depth-procedure coming from your childhood, is this kind of therapy.

Yeah, I think it doesn't show good enough results for the time, effort, and money it costs. I mean at the time it was introduced, it was revolutionary and it has helped people but things like CBT and some of the newer therapies based on it have data to back up that they produce results.

Yes, it is true that some therapies are several times a week or more. But those sorts of intensive therapies are not supposed to last for 13 years. So the most intensive is hospitalization. Then you get IOPs which are outpatient but start at 5 days a week for the whole day (say 9 am to 3 pm). But those gradually wind down to private therapy once a week. (They also involve a lot of group sessions and also non-therapy sessions to develop coping mechanisms.)

If someone is in therapy as much as Spears has been and for as long and is still needing 3x a week private sessions, then I question the program. Something is not right about that.

According to new legal docs, the pop star’s doctors are in favor of booting her father. The claim made in the filing would be a major development — should Spears’ medical team believe that her father is causing harm to her case, the court would likely take that very seriously.
Her mother also has made statements about abusive and controlling actions by her father. Why has it taken so long for her to speak up about it if she knows this has been going on? A couple things I remember reading about her is that BS bought her a house worth $2.5m and in The New Yorker article the good family friend claims the mother agreed with the father being the conservator so BS would be mad at him but not at her. This is after her book that characterized the father as abusive with anger issues and not very involved with his daughter for many years.

There is that pesky little notation in his statement - "... when the time is right." Will the time be right after he gets some kind of settlement or has a chance to move around funds for his benefit or when exactly will the time be right? It sounds like BS's attorney has him on the run to wrap things up, so at least that's a good turn.

I am also highly suspicious. When the time is right. Right for who? For Britney? Or for him? No, no, this reeks of him knowing he's on a losing wicket and trying to make himself look good to throw the hounds off the scent. Hopefully Britney's new firm is smart enough to see right through this nasty little trick and keep pursuing him.

Last week’s document was “not itself a petition for acceptance of his own resignation,” said attorney Matthew Kanin, who is of counsel with the national law firm Greenspoon Marder and a certified specialist in estate, trust and probate law. “It’s actually an objection to being removed from the conservatorship.”
One point of concern: The accounting matters described in the court document can take years to resolve, as they are not a high priority for the court, Kanin said. The initial Twelfth Account of 20`19 finances wasn’t even filed until August 2020, and it has yet to be finalized. And those accountings are likely to be telling, as Britney Spears’ conservatorship is run differently than most where a parent is the conservator.

“In the vast majority of parental conservatorships, the parents don’t get paid to be conservators,” said Harry Nelson, a healthcare attorney and founder and managing partner of L.A. law firm Nelson Hardiman. Nelson, who specializes in the rights of conservatees, said that in his opinion, “The level of payment in this case has been extreme.”

This article has a comment from Britney Spears' attorney about the complete turnaround regarding her father's view:
The petition to end the conservatorship was a massive legal victory and also "vindication" for Britney Spears, Rosengart said in a statement Tuesday.

"It appears that Mr. Spears believes he can try to avoid accountability and justice, including sitting for a sworn deposition and answering other discovery under oath, but as we assess his filing — which was inappropriately sent to the media before it was served on counsel — we will also continue to explore all options," Rosengart said.

There is a paywalled story (on the Vulture website) that says one of the "conditions" for Dad stepping down is that he gets $2 million. I'm not sure if that's part of this filing or the one he made in August....

That's from the previous filing when he said he would step down once the time is right and was apparently trying to negotiate some type of settlement. Her attorney claimed it was an attempt at extortion.

I haven't been following the Britney Spears story, so this may be old news, but - WTF??? Recordings from her bedroom?
Thank you. I coudn't open it but searched for similar content. Didn't know about the recording before.

I think it might come down to the question how ill she is. Her father could argue she needed monitoring because she was suicidal. I wonder if it's possible that she is not ill at all? Then again, a doctor doesn't prescribe lithium for nothing. It's commonly used for the treatment of schizophrenia. Could it be that she is afraid that a diagnosis such as schizophrenia becomes public because she is ashamed of it? And this was the reason why she didn't speak out?
