USPTO Board Rejects ‘Here’s Johnny’ Mark for Portable Toilets
A portable-toilet rental agency and seller won’t be able to register “Here’s Johnny” as a trademark, a patent office appeals board ruled.
Toilets.com Inc., of Shelby Township, Michigan, filed an application in December 2006 to register the phrase. The company said it planned to use it for portable toilets.
A foundation that owns IP rights related to the late talk show host Johnny Carson opposed the registration. The phrase was used by the late Ed McMahon to introduce Carson each night on NBC’s Tonight Show.
The appeals board said the president and owner of Toilets.com Inc. tried to register the mark when Carson was alive. The talk-show host objected and filed a trademark suit in federal court in Michigan.
The court issued a permanent order barring the applicant from registering the phrase, and in 1984 the patent office denied the application.
Toilets.com claimed that because Carson was now dead, it should be allowed the trademark. The appeals board, in a March 25 ruling, said the right to the talk-show host’s name survived his death, and that the foundation owns the right to its use.

New releases are always (almost always - some of the Harry Potter books were released on Saturdays/midnight Fridays) a Tuesday release date. Which January 11th happens to be ... I'm guessing many publishers were be trying to take advantage of being able to release stuff on 1/11/11.
